CBS News reported that the parents of a 15-year-old developmentally disabled boy have filed a lawsuit against CPS. The parents say the Chicago Public Schools organization refuses to acknowledge the alleged rape incident ever took place. They also feel like the CPS staff at the school are blaming their child for the incident.

According to Irika Sargent, a CBS 2 News reporter, CPS attempted to have a judge dismiss the case entirely, twice. In an exclusive CBS interview, the parents, who want to remain anonymous to the public, are claiming that their son was raped at least twice in the bathroom at William J. Bogan Computer Technical High School, located at 3939 W. 79th St.

The accused attacker, another teen student at the school, has a history of accusations of assault. The parent’s attorney, Carolyn Daley,  made the discovery. Their attorney says, “the accused boy had a history of aggressive behavior and sexual misconduct – including 27 conduct violations.” In previous reports, the lawyer claims, “He was found in a bathroom with two other students from the cluster program, or special education program, at Bond Elementary,” Daley’s statement goes on to say, “One of the students was bent over in front of him with his pants down.”

In the CBS exclusive interview, the parent’s attorney revealed that yet another rape incident happened in the school, to a different student, just 8 months later.

According to reports, the parents do not want to press charges against the accused teen, who is also disabled, believing he needed help. The trial begins this week.  Click here to see the exclusive CBS interview.
